1. Introduction

Welcome to Hickok Tools ("Company," "we," "our," "us"). These Terms of Service ("Terms") govern your use of our website, products, and services. By purchasing or using Hickok Tools products, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our products or services.

Hickok Tools is dedicated to providing the highest quality tools to the professional tree fruit industry. All our products are proudly manufactured in the USA using premium materials.

2. Products and Availability

Product Specifications: We strive to provide accurate descriptions, images, and specifications for all our tools. However, we do not warrant that product descriptions or other content on our site is accurate, complete, reliable, current, or error-free. Due to the nature of hand-crafted and industrial manufacturing, slight variations in dimensions or finish may occur.

Availability: All replacement parts and tools are subject to availability. We reserve the right to discontinue any product at any time. While we pride ourselves on keeping replacement parts readily available to extend the life of your tools, we do not guarantee indefinite stock for legacy items.

Professional Use: Hickok Tools are designed for professional use in the tree fruit industry. Users are responsible for ensuring they have the proper training and safety equipment to operate these tools safely.

3. Orders and Payment

Order Acceptance: Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right to accept or decline your order for any reason, including but not limited to: unavailability of resources, errors in pricing or description, or problems identified by our credit fraud avoidance department.

Pricing: Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the product (or any part or content thereof) without notice at any time.

Payment: Payment must be received in full before shipment unless otherwise agreed upon in writing for commercial accounts.

4. Shipping and Delivery

We ship primarily within the United States. Delivery times are estimates and not guarantees. Hickok Tools is not responsible for delays caused by carriers, customs, or weather conditions. All purchases of physical items from Hickok Tools are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Upon receipt, please inspect your purchase. Notify us immediately of any damage or missing parts. Claims for damaged goods must be made within 7 days of delivery.

5. Warranty and Returns

Limited Warranty: Hickok Tools warrants that its products will be free from defects in material and workmanship under normal professional use for a period of one (1) year from the date of purchase. This warranty does not cover normal wear and tear (e.g., blade dulling), damage resulting from misuse, abuse, neglect, or improper maintenance, modifications made to the tool by anyone other than Hickok Tools, or use of non-Hickok replacement parts.

Replacement Parts: We commit to making replacement parts available for our tools to extend their lifespan. However, the installation of replacement parts is the responsibility of the user unless professional repair services are explicitly purchased.

Return Policy: Unopened items in original packaging may be returned within 30 days of purchase for a full refund, less shipping costs. Used tools may only be returned if they are defective and covered under the Limited Warranty.

6. Intellectual Property

All content included on this site, such as text, graphics, logos, button icons, and software, is the property of Hickok Tools or its content suppliers and protected by United States and international copyright laws.

7. Limitation of Liability

To the fullest extent permitted by law, Hickok Tools shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses. Our total liability to you for any claim arising out of or relating to these Terms or our products shall not exceed the amount paid by you for the specific product giving rise to the claim.

8. Indemnification

You agree to defend, indemnify, and hold harmless Hickok Tools and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Pennsylvania, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
